Remote Commissioner

A remote Commissioner of Oaths and Affidavits performs the same function as a regular Commissioner with the exception that the documents are signed electronically online. 

In Ontario, the Commissioners for Taking Affidavits Act (the “Act”), Section 9, states that an oath or declaration must be taken by the deponent or declarant in the physical presence of a commissioner and that an oath or declaration may be taken without being in the physical presence of a commissioner only if the conditions set out in O. Reg. 431/20.

How does the remote signing process work?

  1. The commissioning takes place by an electronic method of communication in which the commissioner and the deponent can see, hear, and communicate with each other in real time throughout the entire transaction.

  2. The commissioner confirms the identity of the deponent.

  3. A modified version of the jurat is used that indicates: a. Commissioning was administered in accordance with the Regulation, and b. The location of the commissioner and the deponent at the time of commissioning.

  4. Once completed, the signed document is sent to you by email.

If a Canadian resides outside of Canada and needs to get documents commissioned, then they may use a Canadian notary/commissioner who offers online services. If a non-Canadian requires documents to be signed and those documents will be used in Canada, or relates to personal or commercial business in Canada, then they may also use a Canadian notary or commissioner who offers remote commissioning services online.

Documents that can be signed online

Notaries are authorized to witness, certify and sign various types of documents including but not limited to the following:

  • Sworn Statement for the Transfer of a Used Vehicle in the Province of Ontario 

  • Sworn Statement for a Family Gift of a Used Vehicle in the Province of Ontario

  • Affidavits (all type including OSAP Affidavits)

  • Statutory Declarations

  • Consent Letter for children travelling abroad (commonly referred to as a travel consent letter)

  • CCDC 9A – Statutory Declaration of Progress Payment Distribution by Contractor

  • Delayed birth registration forms

  • Application to amend birth registration

  • Declaration affirming parentage

  • Common law/Single/marital status certificates

  • Federal government permanent residency card applications

  • Municipal Information Form (MIF) for liquor license

  • Affidavit waiving vaccinations based on religious grounds

  • Statutory declaration by an applicant to correct an error in registration

  • Legal name change application

  • Blank statutory declaration

  • Insurance claims documents

  • Common law status affidavits

  • Special invitations to family members overseas

  • Passport applications (in lieu of guarantor)

  • Attestations for pension purpose, e.g. to confirm recipient's residency and status (dead or alive)

  • Residency document

  • Lost /stolen passport

  • etc.
