What does real estate closing involve and what does a real estate notary signing agent do?

 

  • Real estate closing means that the buyer will review and sign the documents prepared by the lawyer with regards to their mortgage loan, down payment, closing costs and purchase price, and the property title and ownership gets transferred from the seller to the buyer.

  • The responsibilities of a Notary Signing Agent generally include printing loan documents, meeting the signer and notarizing their signature, and quickly returning the documents for processing.

International Property Sale

Notaries may only notarize documents within their jurisdiction; this means a notary cannot notarize a document while he/she is outside of the territory where they are licensed. This should be considered when finding a notary. Notary laws apply where the signing takes place. For example, if a U.S seller is in Canada at the time of closing, then they may use a Canadian notary to perform the notary services in person or online. If a Canadian resides outside of Canada and needs to get documents signed, then they may use a Canadian notary who offers online services. If a non-Canadian requires documents to be signed and those documents will be used in Canada, or relates to personal or commercial business in Canada, then they may also use a Canadian notary or commissioner who offers remote services online. 

Most American states and real estate companies will accept documents that are remotely notarized. It is up to you to confirm with the recipient whether they will accept documents notarized online. Some companies may require an Apostille or Authentication of the document after it is notarized. 

What is Authentication?

Authentication is the process of certifying the genuineness of the signature and seal or the position of an official who has the authority to execute, issue, certify or notarize a document. This is done so that a document executed, issued or certified in one jurisdiction may be recognized in another. 

Global Affairs Canada (“GAC”) authenticates documents for the public through their JLAC branch for a wide range of documents. Americans refer to the same process as an Apostille.

After the authentication is complete, embassies may require that you have the documents legalized. This generally involves the following steps:

  • The document must be an original or certified true copy of the original.

  • It must be stamped by GAC.

  • Some embassies require translation.

  • Some embassies require a cover letter explaining the purpose or use.
